Terms of Service

These Terms of Service ("Terms") govern your use of Ember by Tanopy ("Ember", "the app", "we", "us"). By creating an account or using Ember, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use Ember. By using the app, you represent that you meet this age requirement.

2. Your Account

• You are responsible for maintaining the security of your account and device
• You must provide accurate information when creating your account
• You may not create accounts for the purpose of impersonating another person
• You are responsible for all activity that occurs under your account
• You may delete your account at any time through the app settings

3. Acceptable Use

You agree not to use Ember to:

• Harass, bully, threaten, or intimidate other users
• Post or share content that is illegal, defamatory, obscene, or promotes violence
• Distribute spam, malware, or phishing attempts
• Attempt to circumvent security measures, including encryption
• Scrape, harvest, or collect data about other users without their consent
• Use the service for any illegal purpose
• Create multiple accounts to evade bans or restrictions
• Impersonate other users, individuals, or organisations

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Content

Your content

You retain ownership of the content you create and share on Ember (messages, flares, event posts, comments, media). By posting content publicly (flares, event comments), you grant us a limited licence to display that content to other users within the app.

End-to-end encrypted content

Messages sent through Ember are end-to-end encrypted. We cannot access, read, or moderate the content of encrypted messages. You are solely responsible for the content of your private communications.

Content removal

We may remove publicly visible content that violates these Terms. For encrypted messages, we can only act on the metadata (e.g., suspending accounts) — we cannot selectively remove encrypted message content.

5. Events

• Event organisers are responsible for the accuracy of event information they post
• Ember is a platform for organising events — we are not responsible for what happens at events
• By RSVPing to an event, your attendance status may be visible to the event organiser and other attendees

6. Privacy

Your use of Ember is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.

7. Intellectual Property

Ember, including its design, code, and branding, is owned by Tanopy. You may not copy, modify, distribute, or reverse-engineer the app or any part of it.

8. Availability

We strive to keep Ember available at all times but do not guarantee uninterrupted service. We may temporarily suspend the service for maintenance, updates, or circumstances beyond our control. We are not liable for any loss resulting from service downtime.

9. Limitation of Liability

To the maximum extent permitted by law:

• Ember is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages arising from your use of the app
• Our total liability is limited to the amount you paid us in the 12 months prior to the claim (which, for a free app, is zero)

10. Termination

• You may stop using Ember and delete your account at any time
• We may suspend or terminate your account if you violate these Terms
• Upon termination, your right to use the app ceases immediately

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the app. Continued use of Ember after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
